President Dina Boluarte promulgated this afternoon the law granted by amnesty for military and police and self -defense committees that participated in the fight against terrorism between 1980 and 2000, in a ceremony held in the Government Palace.
The publication of this rule is given just over a month after the Permanent Commission of the Congress approved in the second vote the opinion held in the bill 7549/2023-CR, and in the midst of the questions of the Public Ministry, the Judiciary and above all with the Inter-American Court of Human Rights, with which the Executive faced the law.
“Today is a historic day for our homeland, Peru pays justice and honors those who with value and delivery faced one of the most terrible threats of our history: terrorism. A scourge that tried to snatch freedom and sow fear,” said the president in her speech before ministers, congressmen, military, members of the Chavín Command of Huántar and other guests.
The Head of State said that with this law her government “is ending these acts of injustice.” “With the promulgation of this law we recognize the sacrifice of the members of the Armed Forces and the Police and the Self -Defense Committees and we return the dignity that should never be questioned,” said Boluarte
Regarding this law, the president pointed out that her government firmly rejects any external and internal interference.
“Those national and international institutions included by totalitarian ideologies that seek to submit to Peru to their designs are wrong. If they put themselves aside from those who violated the human rights of our compatriots, we are on the side of the Peruvians of good who only want peace,” he said.
“We cannot allow the perpetrators to become victims and that the defenders of the homeland are pointed out as enemies of the nation that they swore to protect,” said the president in her message.
The norm
This benefit will be applied to those who do not have a final sentence with the quality of a judged thing, be denounced, investigated or processed, for crimes related to the fight against terrorism, in addition to troops over 70 years that are sentenced.
After the opinion was approved in the Legislative, the Inter -American Court of Human Rights (IDH Court) formally requested immediately suspend the process of the norm for its possible affectation to the fulfillment of international sentences on human rights.
He said that, if not stopping their promulgation, the authorities must refrain from applying this law until the court can thoroughly analyze their impacts on the rights of victims. In addition, a public hearing was convened for August 21, in which the victims will be heard, the State and the Inter -American Commission on this issue.
The court of the Court was immediately and strongly rejected by the Executive, first through the ministers and the premier Eduardo Arana, and then by President Dina Boluarte, who in several speeches called as interference what was said by this instance and set his favorable position with the law.

For the constitutionalist Aníbal Quiroga, the amnesty law is absolutely unfeasible by inconvenience and described it as a populist.
“There is no massive or generalized amnesty. If it occurred, I did not believe it, it would be fulminated by the Constitutional Court and if not by the Inter -American Court. It is a populist norm.
