The hearing in which the preliminary hearing would be restarted for the alleged members of a drug trafficking network that accused César Emilio Peralta (the Abuser) could not be known this Friday as scheduled.
This is due to the fact that Judge Franchesca Potentini, in charge of the process, presented a health condition that prevented her from being at the hearing, which was postponed for next Friday the 29th.
The information was released by a substitute judge of the Second Court of Instruction of the National District, who did not give more details about the health of Potentini, who was assigned the case last month, after Judge Patricia Padilla was removed. of the same after being challenged by the Public Ministry for issuing value judgments on the file.
It will then be next Friday when Potentini can hear the preliminary hearing, which will have to start from scratch, since he cannot continue where Judge Padilla left off.
The situation is due to the fact that, seeing a change of judge, who is the one who has to make a decision on whether or not this case goes to trial, the principle of immediacy established by the Code of Criminal Procedure was lost.
According to what was explained by jurists, the preliminary hearing will have to restart since Judge Potentini is not aware of what was discussed there and cannot “catch up” just by reading the minutes of the hearing or the accusation presented by the prosecutors.
This judicial process reached the courts in August 2019, after the network syndicated to “César el Abusador” was dismantled after a long investigation. Although the case has been in court for almost three years, it was not until last year that the preliminary hearing could begin.

The Public Ministry has established that the alleged network of César Emilio Peralta, who is currently in a prison in Puerto Rico, managed to place, stratify and integrate into the national financial system more than RD$3,418,786,413 from drug trafficking.
Those involved in this case are Marisol Franco, wife of César el Abusador; the ex-player Octavio Dotel, José Bernabé Quiterio, Manuel Sánchez, Johanny Paniagua, Yadher Vásquez (Jake Mate) and Edward Patricio Montero Cabral (the Zapatazo). In addition, Alan Bueno Alcéquiez (Alan Dollar), Rafael Reyes, Rodolfo Cedeñ, Heriberto de la Cruz (Erick Aqua), Lidio Peña, Jeifry del Rosario, Melchor Alcántara, Genri Dantana Badía, among others.
The accusing body has said that they have an accusation “very strong” and that they have a “safe” opening order for trial.
