The Federal Court 2 of Paraná signed on Tuesday an “interim or precautionary precautionary measure” requested by the national deputy of the Front of All Marcelo Casaretto, in which it orders the presidents of the Chamber of Senators and of Deputies of the Nation to refrain to appoint new members in the Council of the Judiciary.
“The objective of my protection is let the Congress of the Nation sanction a new lawand there is no attempt to put into force a law that was already repealed in 2006,” said the deputy from Entre Ríos through his social networks.
Casaretto recalled that on Thursday of last week the Senate gave half sanction to “a project that we must deal urgently with Deputiesguaranteeing balance in the representation as indicated in article 114 of the National Constitution and the participation of the opposition”.
If approval is not achieved in the lower house before the Fridayboth Houses of Congress should designate a representative each to complete the new integration of the body that completes the 20 advisersaccording to a decision of the Supreme Court of Justice.
That new composition is the one that would be valid again in the event that Congress does not sanction the law within the term established by the Supreme Court, that declared unconstitutional the norm that is currently in force.
Aware of the precautionary measure, the president of the radical bloc of Deputies, Mario Negri, tweeted that “Kirchnerism is looking for any device to breach a ruling by the Supreme Court of Justice. This ruling is clear: if on 4/15 there is no new law, the 1997 law is put into effect. Since 1862 the Court is the one who has the last word when the validity of a law is questioned“.
