The Legal Representative of Popular Action, Fernando Luis Arias-Stella Castillopresented before the National Election Jury (JNE) a request for annulment against the resolution that annulled his primary elections and left him out of the 2026 general electionsin an appeal filed this December 15, a few hours before the deadline for the official proclamation of the results of the internal process expires.
“We request that Resolution N. 745-2025-JNE be declared null and void due to the serious effects on the constitutional rights of defense, due procedure, due motivation, presumption of innocence, to elect and be elected and others of Popular Action and the flagrant non-compliance with the principle of legality by the JNE,” reads the document presented by the political organization.

In its appeal, Acción Popular maintains that the JNE violated basic constitutional rights by resolving the challenges without calling a public hearing or allowing the presentation of defenses, despite the fact that, according to it, all the challenges were presented without numerical support, an essential requirement established in the electoral regulations.
Furthermore, the party warns that several of the resources were filed outside the legal deadline and that, even so, they were admitted and evaluated, which would constitute an arbitrary action and contrary to the principle of legality.
As is remembered, The JNE declared the nullity of the primary elections of Popular Action after accepting various challenges presented by members, considering that there were irregularities in the delegate election process. The decision generated an internal crisis in the party and annulled the election of its presidential formula, as well as candidates for the Senate, Deputies and Andean Parliament.
It is important to emphasize that the JNE resolution is final and unappealable within the electoral process, which places Popular Action in an extreme situation. If the annulment request is not successful, the exclusion of the political organization from the 2026 electoral contest would be ratified.

Their eventual presence in Congress from 2026 will depend on the decisions they make in their personal capacity and whether other political organizations decide to incorporate them into their lists in the final stage of the electoral process.

Among them, receiving a formal invitation from another party and having the express authorization of the acciopopulista leadership to compete under a new registration.
The main obstacle, however, is time. According to the JNE schedule, December 23 is the deadline for registering candidates for the Senate and the Chamber of Deputies, which leaves these congressmen with less than ten days to finalize an eventual nomination. Added to this is that several of them are facing public questions, both for their legislative performance and for investigations that are still in progress.
