The PNPmeanwhile, maintains that cash acted in the middle of a risky situation and that the shooting would have been accidental. The general Oscar Arriola confirmed the identity of Third Class Petty Officer Luis Magallanes as a participant in the intervention, but denied that there was a direct order to shoot. The case remains under investigation by the Prosecutor’s Office, which has ordered new ballistic tests and summonses to those involved.
Ruiz Sanzknown in the hip hop scene as ‘Trvko’was participating in the march called by citizen groups when he received a gunshot wound to the chest. Eduardo Ruiz’s lawyer denounces the PNP’s cover-up and asks that the Prosecutor’s Office take the case without intervention from the Dirincri
Rodrigo Noblecilla, lawyer for the family of Eduardo Ruiz Sanz, denounced alleged maneuvers by the National Police to alter evidence and cover up the person responsible for the shooting that ended the life of the young rapper during the October 15 march. According to him, the institution seeks to construct a false version of the events and has even tried to modify evidence in the Lima morgue to support its narrative.
The lawyer questioned that the defense of non-commissioned officer Luis Magallanes – identified by the PNP commander, Óscar Arriola, as the author of the shot – had maintained that the projectile ricocheted off the ground before hitting Ruiz’s chest. “They want to invent the rebound theory,” Noblecilla warned, rejecting the intention to present the case as an accident.
Noblecilla also warned about contradictions between the versions of the Minister of the Interior and General Óscar Arriola, head of the PNP. While Arriola described the crime as an isolated case, the head of the sector denied any link between Magallanes and the death of the young man. “They want to change a victim, they want to make her the culprit,” said the lawyer, who maintains that at least four agents would be involved in the operation that ended with the murder of Ruiz Sanz.
Eduardo Ruiz’s defense demanded that the case be kept under the direct control of the Public Ministry and not the National Police, considering that the Dirincri would have lost independence in the proceedings. According to the lawyer, said police unit would have been used by the Government to repress protests and deploy undercover agents dressed in plain clothes and armed, which, in his opinion, compromises the impartiality of the investigation into the death of Eduardo Ruiz.
“I ask that the investigation be carried out in the tax office that absolutely nothing is coordinated with the Dirincri. Because, I repeat, the Dirincri has been instrumentalized to repress, to bring in undercover agents, they were civilians with firearms,” he commented.
Defense of the non-commissioned officer maintains that the shot was accidental and without intent to kill
Luis Miranda, lawyer for non-commissioned officer Luis Magallanes, assured that his client did not act with homicidal intent. According to his version, the projectile would have been directed towards the ground during a deterrence attempt, but ended up hitting the young man after bouncing. The defense argues that it was an accident in a context of confusion and not a deliberate act.
The legal representative also maintains that Magellan responded to a situation of extreme tension and imminent danger, in which he tried to repel an attack. In his opinion, what happened should be evaluated within the framework of a possible human error and not as a qualified homicide. He considers that the Prosecutor’s Office must determine if there was a “prohibition error”, that is, an action without full awareness of its criminal nature.
“The shot fired by non-commissioned officer Magallanes was in the direction of the ground, not directly at the people. The bullet ricocheted and ended up hitting the young Mauricio Ruiz. There was no intention to kill. In any case, it would be a prohibition error, not a qualified homicide. He tried to repel an attack in a matter of seconds, which must be evaluated in court,” he commented.
Regarding his participation in the protests, the defense stated that Magallanes belonged to the kidnapping division, but was temporarily assigned as an intelligence agent by superior orders. He indicated that his work focused on detecting possible crimes or the presence of weapons among the protesters. However, when his shift ended, he would have been identified by the crowd as a member of the Terna group, which triggered the tension that ended with the fatal outcome.
“Magallanes belonged to the kidnapping division, but by superior order he was assigned as an intelligence agent to detect flagrant crimes or the presence of weapons. His service ended at 11 at night, and upon leaving he was identified by protesters as a member of the Terna group. He was not trying to make an arrest,” he said.
Judiciary orders preliminary arrest against non-commissioned officer Luis Magallanes
The Judiciary ordered the preliminary detention for seven days of the third-class non-commissioned officer Luis Magallanes Gavidiaaccused of being the author of the shot that ended the life of the young protester Eduardo Ruiz Sanz during the October 15 march in Lima. The measure was issued by the Ninth National Preparatory Investigation Court at the request of the Public Ministry, which is investigating the agent for the alleged crime of qualified homicide.
According to tax proceedings, Magallanes was in the surroundings of the France Squarewhere Ruiz was hit by a bullet in the chest while fleeing police repression. Images and videos obtained by the prosecution place the non-commissioned officer as the person who fired the shot. In addition, the participation of three other police officers who were present in the operation has been identified.
The detention requirement also extends to Omar Saavedraanother agent who would have participated in the events. The judicial resolution notes contradictions in the police reports and the official version of the Ministry of the Interior, which initially denied the intervention of undercover agents during the protest. With this decision, the investigation into the murder of Eduardo Ruiz takes a new step in the search for criminal responsibilities within the PNP.
