The congressman from Podemos Peru and president of the Congressional Oversight Commission, Juan Burgosis the author of this initiative. The text proposes modifying the Political Organizations Law so that “up to one presidential candidate and up to 20% of all presidential candidates Congress“may be appointed by the body of the political organization established by the statute.
The law currently provides that 20% of the parliamentary candidates of a political party can be appointed. But the novelty raised is that in the presidential formula there may be a candidate who is not a militant.
The designated candidates, it should be noted, may be members of the political party or guests who have no experience with the organization.
Parliamentarian Burgos’ colleagues on the bench signed the project, including the founder of Podemos Peru, José Luna Gálvezand the Congressman Edgar Tello.
Tello considers running for president
Congressman Tello has been promoting his own political party called Peru For All, which is not yet registered in the Registry of Political Organizations (ROP)but on his social networks he promotes the legislator with a Perulibrist past as his candidate for the presidency in the 2026 general elections.

On July 14, Tello’s group greeted him on his birthday. As is known, Tello was sheltered in Luna’s organization after his time on the benches of Perú Libre and the Magisterial Bloc.

Tello is not affiliated with any political organization and current electoral rules do not allow him to be a presidential candidate, but with his party’s project the panorama changes. Experts question proposal
Electoral lawyers José Villalobos and José Naupari questioned Podemos Peru’s bill. “I’m sure they don’t have anyone of importance among their members,” Villalobos commented. “It is absurd because you are allowing that, ignoring the will of its militants, a candidate for the presidency is going to be imposed by hand and that is openly contrary to article 35 of the Constitution which says that democratic functioning must be guaranteed by law of political parties,” lamented Naupari.
Naupari warned that in some political organizations the decision to appoint candidates is in the hands of the president. Podemos Peru is an example. Its statute states that “the direct designation of candidates is the prerogative of the president – founder of the party, and a citizen not affiliated with the party may be a candidate.” Thus, the last word in that party belongs to Congressman José Luna Gálvez.
