The Plenary of the National Board of Justice (JNJ) approved by majority that its president, Gino Ríos Patioremains in front of the institution despite the final sentence that registers for family violence.
The vote was 4-2: Those who voted for river vacancy were Francisco Távara and Germán Serkovic. María Teresa Cabrera, Jaime de la Puente, Víctor Chanduví Cornejo and Cayo Galindo Sandoval opposed.
The conviction received by the head of the JNJ, in 2011, is based on the complaint filed by his then wife. The Sunday fourth power reported that the demand was backed by psychological expert opinions and evidence of psychiatric treatment.
The Organic Law of the Entity stipulates that one of the prohibitions to integrate the JNJ is to be convicted “with a consensual sentence or executed by the Commission of Dolo Crime.”
Wilber Medina, Rivers Patio’s lawyer, told Peru21 that the full majority concluded that there was no omission of information regarding the sentence.
“It is not a condemnation for malicious crime. Gino Ríos demanded divorce for abandonment of home and she, a year, reconvenes. She has said in a signed letter that her lawyer magnified what she commented; in addition, what is treated in the civil via is a sentence, does not condemn, and what the rule says so that you are not a member (of the JNJ) is not to have been condemned for a painful crime,” he explained.
Medina insisted that family violence just became a crime in 2015, four years after the case of his defendant.
“Assessing with the new protocol, with the law of 2015 that typifies family violence as a crime, that is not violence and less psychological damage,” he said.
River defenestration was voted after the complaints filed by the congressmen Sus the walls, Flor Pablo, Ruth Luque and Héctor Acuña.
