The Plenary of Congress of the republic authorized the Board of Directors of Parliament to present a bill that seeks to give rise to a legislative resolution that allows the lifting of the jurisdiction of the former president Pedro Castillo.
With a total of 64 votes in favor, 35 against and one abstentionthe congressmen gave the green light to discuss the aforementioned resolution.
With this, the parliamentarians had the objective of removing the immunity which corresponded to Pedro Castillo for his inauguration as president and can be brought to justice for different charges derived from the failed coup d’état.
Although the congressmen from caucuses related to the former president sought to have the parliamentary proposal reconsidered, Being in the minority, the authorization to present the PL was ratified by the Plenary.
Opposition congressmen achieved objective
One hour after the announcement made by the parliamentarians regarding the jurisdiction of Pedro Castillo, finally, with the vote of the opposition benches to the former president, managed to reach their goal and lifted Castillo’s prerogative of impeachment.
A total of 67 votes in favor and 45 against decided the fate of the ex-president’s immunity. With this, Pedro Castillo can be investigated and tried like any other civilian.
It should be noted that, The former head of state of Peru for one year and five months faces charges of rebellion and conspiracy against the state for the violation of the Constitution after the events that occurred on December 7, after announcing the dissolution of Congress.
What is political prejudice?
According to the Constitutional Court in a ruling dated October 2010, “the political prejudice constitutes a prerogative or privilege of the senior officials mentioned in the aforementioned article 99 of the Constitution, which consists in the fact that they cannot be prosecuted —validly— by the ordinary criminal jurisdiction for the commission of a crime”.
In other words, it is a valid form of immunity for high-ranking State officials.
However, this figure is not perennial and may be subject to being revoked by the Congress of the Republic.as long as “the credibility of the facts that are the subject of the accusation has been determined and that these are subsumed into one or more criminal types of a functional order.”
