The former mayor and former governor of the Callao region Alex Kouri Bumachar He will not be able to participate in the general elections that will be held in 2026, as he anticipated months ago, which was his intention.
The Judiciary confirmed his disqualification from running for a popularly elected position for not having complied with the payment of the 26 million soles for civil reparation that was imposed on him in the sentence handed down against him, in 2016, for the Vía Expresa del Callao (Convial) case and for which he served a 5-year sentence.
Through his legal defense, Kouri presented an amparo action to annul the disqualification and remove his name from the Registry of Civil Reparations (REDEREC).
To this end, he alleged that at the time of the conviction, handed down on June 30, 2016, the Penal Code established that rehabilitation proceeded automatically upon completion of the sentence even without paying civil compensation.
The court ruling, however, has now established that compliance with payment for this concept is an essential requirement for the rehabilitation of rights and the lifting of accessory sanctions derived from a conviction for corruption.
Months ago, it should be noted, the Constitutional Court (TC) had already declared inadmissible a habeas corpus claim filed by the defense of Álex Kouri, who last March announced his intention to run for the Senate of the Republic in the 2026 general elections.
According to the expert on electoral issues José Naupari, the law is clear and establishes that “people with a conviction in the first instance, which is in force for any intentional crime, will not be able to apply for popularly elected positions in the 2026 elections.
Nor, he added, can those who have or have had a court sentence for illicit drug trafficking, violation of sexual freedom, collusion, embezzlement, corruption of officials, even if they have completed their sentence, because legally they have a permanent impediment.
