Nine months of pretrial detention were dictated to a commissioner and two police noncommissioned officers for the alleged commission of the crime of passive bribery in the exercise of the police function, because they would have requested S/5,000 to return a vehicle that had intervened in the city of Sullana.
It was the first office of the Prosecutor’s Office specialized in corruption crimes of Sullana officials, led by provincial prosecutor Luis Ramos Rioja, who presented said requirement, being supported by the attached prosecutor, Harold Martinez Requena, who accredited the serious and founded elements of conviction that link those accused with the fact investigated, a prognosis of penalty greater than five years and the presence of the process.
The measure was issued by Judge Carlos Lindo Yajamanco against the NCOs Richard Junior Cherres Antón as an alleged author.
In addition, the greatest PNP Francy Duggar Barzola Álvarez and the PNP Petty Officer Andy Luis Flenque Sucupe, both as alleged accomplices, for the alleged commission of the crime against the public administration in the modality of its own passive bribery in the exercise of the police function.
The case happened on January 10 of this year, when a man was intervened by the two non -commissioned officers when they carried out an operation near a laundry room on Ricardo Palma Street in the José Carlos Mariátegui settlement in Sullana. In that place the agents intervened the truck that had an arrest warrant due to a bank’s debt.
Then, said vehicle was admitted to the El Obrero police station. However, the complainant filed all the required documentation. Despite this, the police persisted in the refusal to return the truck and conditioning it with the payment of S/5,000.
