The Comptroller warned that the municipality of Tambogrande did not apply the penalty and paid for services not provided in the infrastructure recovery work of IE No. 20153 of the Santa Ana town center, in the district of Tambogrande, causing economic damage of more than 68,000 soles. The work was carried out by the Santa Ana Consortium, with an investment of S/ 8.8 million. The contract was also signed with the PGT Supervisor Consortium, to supervise the work. Pool Gonzales Tomiyama was the construction supervisor.

The specific control report No. 009-2025-2-2413-SCE revealed that the District Municipality of Tambogrande did not apply the penalty to the contractor and paid for services not provided, despite the contractual breach in the permanent participation of the resident of the work.
In the bases of the selection process, the obligation to have the permanent participation of a construction resident was established, as well as the application of penalties in the event of the absence of said professional. However, it was verified that he did not provide his services permanently or continuously on the construction site for 26 days, since he was also working simultaneously as a construction resident on a project in the Pacaipampa district, in Ayabaca.
The penalty would be for 26 days, counted from May 21, 2024 to June 20 of the same year. The economic loss is 68,750 soles.
Despite this situation, it was not observed or warned by the construction supervisor or in the monthly valuation reports, much less in the final settlement of the contract. This led to the penalty not being applied and the payment for services not provided was even less deducted.
Meanwhile, the manager of Infrastructure Works, Liquidation and Maintenance, in charge of functional supervision, did not adopt preventive or corrective measures despite the alerts in the Comptroller’s reports.
The report details that there is a contract for the construction resident, Dante Pariahuache, at the Pacaipampa construction site, for which reason he would have been at fault, despite the fact that the engineer presented a medical certificate to justify his absence at the Tambogrande construction site, which would lack veracity, configuring an alleged falsehood.
On the other hand, they have identified non-compliance on the part of the contractor, who was not warned or informed by the construction supervisor, engineer Pool Roberto Gonzales Tomiyama.
The then construction resident and the supervisor are involved in alleged irregularities committed at this Tambogrande construction site.
More than 700 children study at this school and this work has already presented other observations where the work would be poorly done, since the premises are in a vulnerable construction zone.
