PGR advocates loss of the position of two former dictatorship

The Attorney General’s Office (PGR) defended on Monday (3), at the Superior Court of Justice (STJ), the loss of public office of two former agents who worked in the military dictatorship between 1970 and 1976.PGR advocates loss of the position of two former dictatorship

In the appeal presented to the STJ, the Attorney’s Office argued that the loss of the positions of the army colonels Carlos Alberto Brilhante Ustra and Audir Santos Maciel, already deceased, who were commanders of the Detachment of Information Operations – Center for Internal Defense Operations (doi -Codi). The agency was responsible for the acts of torture practiced during the dictatorship.

In the understanding of Deputy Attorney Aurélio Rios, Law No. 1,711/1952 determines the dismissal of civil servants who commit aggression against individuals.

According to Rios, thus, although deceased, the accused cannot remain with the public administration. If accepted by the STJ, the breakup of the bond may have reflexes in the payment of pensions and benefits received by family members of the former military.

PGR also seeks the recognition of the imprescriptibility of actions that seek the recognition of damage caused by ex-agents of the dictatorship.

In understanding the Attorney’s Office, the Amnesty Law should not be focused either to favor the accused.

“This is because what is postulated is not the reparation of moral damages to the state, but for all Brazilian society, subject to inhuman practices for the repression of their freedom of political expression during the military regime, especially the performance of former commanders From Doi-Codi, “said the deputy prosecutor.

Amnesty law

Last week, the PGR argued that the Federal Supreme Court (STF) analyze the legality of the application of the Amnesty Law in the case of the five military personnel accused by the death of former federal deputy Rubens Paiva during the period of dictatorship in Brazil.

The PGR seeks to review the STJ’s decision that suspended criminal proceedings against five military personnel based on amnesty law.

According to the prosecutor, José Antônio Nogueira Bilham, Rubens Paim Sampaio, Raymundo Ronaldo Campos, Jurandyr Ochsendorf and Jacy Ochsendorf are accused of involvement in the death of Rubens Paiva in January 1971, in the premises of the army information operations detachment, in Rio de Janeiro.

In the document sent to the Supreme, Deputy Attorney Maria Caetana Cintra Santos said that the international legal understanding of the issue has defined that Brazilian amnesty law cannot be applied in cases of serious human rights violations.

The judgment date has not yet been set.
