Florián’s return has generated mixed reactions.

President Gustavo Petro formalized on September 21 the return of Juan Carlos Florián to the Ministry of Equality and Equity, after a brief output for a lawsuit related to the breach of the installment law. The decision was made effective through Decree 1012, in which the interim designation that had been made after the suspension of Florián’s appointment by the Administrative Court of Cundinamarca was revoked.

The controversy arose when the high court temporarily suspended its designation by considering that the cabinet did not comply with the minimum female representation required by law. According to Law 581 of 2000, known as the Fees Law, at least 30% of the highest decision -level positions in the State must be occupied by women. With Florián in the Ministry of Equality, the Executive did not reach that percentage.

Given the measure, the government reacted quickly and made strategic adjustments in other portfolios to correct the imbalance. One of the key movements was the appointment of Yeimi Carina Murcia as Minister of Information and Communications Technologies (ICT), a decision that allowed to restore the legally required gender parity and open the way for the return of Florián.
With the new balance fulfilled, the government repealed the decree that had temporarily replaced it, and Petro proceeded to reinstall it in office. In this way, Florián becomes again the head of a key ministry for the government’s social agenda, especially in issues of equity, gender and inclusion.
Florián’s return has generated mixed reactions. While some sectors value the formal compliance of the law and the defense of government technical cadres, others question the way in which the situation was handled, ensuring that it was a political play to make fun of the spirit of the quota law without making substantive changes.
In the midst of the controversy, the Ministry of Equality continues in the center of the public debate. Florián will now have the task not only to advance with the government’s inclusion policies, but also to demonstrate legitimacy and leadership in a position that, beyond the technical, is marked by a strong political and social symbolism.
