Last Thursday, the Peru Libre bench presented a bill that seeks to reduce the disqualification of public officials, which will benefit its fugitive leader of justice Vladimir Cerrón.

The bill seeks to modify article 426 of the Penal Code, so that the main disqualification penalty is not higher than the penalty imposed.
According to the legislative proposal, which will be debated and put to a vote in the Justice Commission that is chaired by Perú Libre —through congressman Isaac Mita—, the text indicates that the aforementioned article 426 will read as follows:
“The crimes provided for in chapters II and III of this title, which do not contemplate the penalty of disqualification, are also punished
in accordance with sections 1, 2, 4 and 8 of article 36. The disqualification in this case is from one to five years. In the case of articles 382, 383, 384, 387, 388, 389, 393, 393-A, 394, 395, 396, 397, 397-A, 398, 399, 400 and 401, the main disqualification penalty will not be superior to the sentence imposed. In these cases, it will be perpetual when any of the following events occur:[…]”
Peru Libre bill to benefit Cerrón.
The former regional governor has been a fugitive since October 2023 when he was sentenced for collusion in the “Wanka Aerodrome” case. He is sentenced to three years and six months in prison.
During the same period, the Judiciary imposed disqualification against Cerrón from holding any public function or office, even if it came from a popular election. The measure expires in January 2027, according to an AFP report.
