the bench of Free Peru filed a constitutional complaint against congressmen Jorge Montoya, Jose Cueto Y Martha Moyano for allegedly infringing articles 38 and 39 of the Constitution, within the framework of crimes against life, body and health under the modality of criminal organization and abuse of authority. The initiative also requests the dismissal and disqualification from public service for 10 years.
According to the complaint, the parliamentarians are inciting the protests that take place in the interior of the country due to the political crisis of the Government of Dina Boluarte.
In the case of Jorge Montoya, the statement made by the spokesman for Popular Renovation on the situation of Pedro Castillo, in March 2022, is attached, in which he states that the vacancy will be complicated compared to former presidents Martín Vizcarra and Pedro Pablo Kuczynski .
It is added that Montoya, in order to continue neutralizing his political opponents, creates “false” accusations, as is the case with the complaints he filed against the governor of Puno, Germán Alejo Alpaza, the former president of Bolivia Evo Morales and the founder of Peru Libre, Vladimir Cerrón.
The accusation also reaches José Cueto for the publication he issued on his Twitter account on December 21, 2022, when he indicated that there is a plan for him to begin to return to calm.
“Eliminate these people, remove them from the political context,” recalls the complaint before what Cueto said.
Finally, it states that Martha Moyano spoke about the strategies of a political sector to face the protests in the country.
“The Prosecutor’s Office is not counted, it is not said. Of course it is giving results, that we are advancing. All from our trench. We from Congress, you from the street, the jurists in the areas of the Judiciary”, is detailed in the factual basis against Moyano.
