With the publication of Supreme Decree No. 115-2025-PCM in the Peruvian, Peru now has an official regulation on the use of artificial intelligence. According to the Executive, the measure seeks to guarantee an ethical, responsible and sustainable application of this technology to contribute to economic and social development.
The norm covers both public and private use of artificial intelligence and sets principles such as non -discrimination, transparency, sustainability, data protection and human supervision. Its application will be progressive and will not represent additional expenses for public treasure.
This regulation on artificial intelligence will be mandatory for all state entities, at all levels of government.
This standard also extends to public and private companies, universities and social organizations integrated to the National Digital Transformation System.
The regulation excepts only the personal use of artificial intelligence, as well as applications related to national defense and security, always under respect for guiding principles. Its implementation seeks to protect fundamental rights and ensure legal certainty.
The Ministry of Government and Digital Transformation of the PCM will be responsible for directing and supervising the implementation of the National Artificial Intelligence Policy. The issuance of technical guidelines, the promotion of good practices and the guarantee of accountability mechanisms will also be in charge.
Its functions include the elaboration of the National Artificial Intelligence Strategy (ENIA) to 2030 and the Data Government Strategy, which must be presented within a maximum period of one year.
In accordance with the regulations, state entities will have to adopt an institutional policy on the use of artificial intelligence, based on their guiding principles. They must also form multidisciplinary technical teams and use international standards, including ISO/IEC 42001.
Likewise, the entities will be obliged to publish the source codes developed with public funds and to guarantee human supervision in automated decisions that may impact fundamental rights, particularly in the fields of health, justice, education and social programs.
According to the regulation, artificial intelligence is classified at high risk and improper use. The latter is expressly prohibited and involves practices such as massive surveillance lacking a legal basis, sensitive data profile, the prediction of crimes without objective support and the use of autonomous systems with lethal capacity.
High risk systems are authorized, provided that they meet transparency, human supervision and impact assessment requirements, especially in sensitive areas such as health, employment and education.
Private companies will be obliged to adopt policies for responsible use of artificial intelligence. In the case of high -risk systems, they must ensure algorithmic transparency, carry out security audits and guarantee human supervision.
These obligations will not be applied immediately to all companies, since the deadlines will vary according to their size and sector, allowing a gradual implementation. In the case of mypes, they will have a period of between two and three years to adapt to the technical requirements.
Within the framework of the inclusive approach to the regulation, a digital channel on artificial intelligence was enabled on the unique state platform (www.gob.pe/iaperu).
