Desperate to regain his freedom, the former coup president Pedro Castillo Terrones Through its lawyers, it has been distributing the Habeas Corpus appeal in different courts of justice in the country and Huancayo is no stranger to it.
After the Preparatory Investigation Court suspended the hearing for the request for preventive detention for 18 months against Castillo Terrones and Aníbal Torres, a file with 15 pages signed by Raúl Noblecilla Olaechea was presented by a panel of parties before the Superior Court of Justice of Junín (CSJJ) in favor of the former president and against the Congress of the Republic.
In writings, to which Peru21 had access, Castillo through his lawyer Noblecilla -who also defended Guillermo Bermejo- considers that “There is a violation of the right to personal liberty of José Pedro Castillo Terrones as a result of the illegal vacancy”. He also considers that there is a serious violation of personal freedom against him who is also being investigated for alleged acts of corruption.

Noblecilla is asking the Constitutional Judge of Huancayo to declare this appeal well founded and orders the release of Pedro Castillo; In addition, it requires the nullity of the presidential vacancy procedure carried out by Congress to be declared.
The former CSJJ Preparatory Investigation Judge, Emiliano Ramos Álvarez, maintains that Pedro Castillo would be “Trying to use the friends of (Vladimir) Cerrón to see what path they give to this habeas corpus (within the CSJJ). He draws attention to the fact that Noblecilla who is Castillo’s lawyer presents him in Huancayo ”.
He also wondered if there will be a judge in Huancayo who could protect the Habeas Corpus?
SAME RESOURCE IN SAN MARTIN
On the 12th of this month, the lawyer Héctor Rabelo Llamacponcca filed the same appeal in favor of Castillo Terrones asking for his release, but –unlike Noblecilla- Rabelo did not request the annulment of the vacancy.
The Habeas Corpus was sent to the Preparatory Investigation Judge of Tarapoto, in San Martín, on the morning of last Monday in a file of 13 pages.
Former magistrate Ramos has pointed out to Peru 21 that they are raising the same appeal at the national level. “They want to see if Huancayo matches them or not, but I think they are going to reject it.”
“It is striking that Noblecilla, being an experienced lawyer, is unaware that the current Constitutional Procedure Code (CPP) has modified the regulation of Habeas Corpus because before it was presented in any part of the country, but now with the CPP it only arises with the competent judge, which in this case would be in Lima because Castillo is being held there. In that sense, it is quite strange that he presented it in Huancayo, ”he declared. He also said that it would be a scandal if Pedro Castillo’s request could be protected because the magistrate would be committing prevarication.
