The Permanent Criminal Chamber of the Supreme Court, headed by Judge César San Martín, once again rejected the former president’s request Pedro Castillo so that the criminal proceedings against him for the failed coup d’état of December 7, 2022 are archived and his reinstatement as President of the Republic is ordered.
Castillo’s legal defense maintains that the resolution issued by Judge Juan Carlos Checkley on February 2, in which the request for protection of rights that he made to leave the Barbadillo prison is declared inadmissible, violates the guarantees of defense, jurisdictional protection , due process and due motivation, since when the former president was arrested the colonel in charge of the operation did not communicate the facts for which he was deprived of his freedom.
However, according to RPPSan Martin specified that This appeal is a reiteration of previous approaches and that Castillo’s arrest was the subject of several rulings by that court and no new evidence has been provided. In that sense, he emphasized that it is not compatible with the principle of procedural good faith to reiterate requests that have already been rejected.
As is known, the Second Transitory Supreme Prosecutor’s Office Specialized in Crimes committed by Public Officials requested 34 years in prison against Castillo by accusing him of the alleged crimes of rebellion, abuse of authority and serious disturbance of public tranquility to the detriment of the state and society. The criminal process is in the intermediate or control stage of this tax accusation.
