The Power of attorney reported that the Supreme Court of Preparatory Investigation forwarded to the Permanent Criminal Chamber of the Supreme Court the appeal filed by the defense of the President of the Republic, peter castleagainst the resolution that dismissed the protection of rights that he presented.
“The Supreme Court of Preparatory Investigation sends to the Permanent Criminal Chamber of the Supreme Court an appeal file filed by the defense of Pedro Castillo against the resolution that dismissed the appeal for protection of rights”, stated the institution on its social networks.
Through his lawyer, the head of state had requested that the fiscal provision that ordered the expansion of the preliminary investigation against him be annulled for the alleged crimes of criminal organization, aggravated influence peddling and aggravated collusion.
As it is recalled, on June 23, the Supreme Court of Preparatory Investigation declared the protection of rights unfounded for alleged violation of the constitutional principles of procedural legality and the principle of legal certainty, as a result of the investigation by the Office of the Prosecutor of the Nation of the investigations against the head of state.
Previously, on May 31, the defense of Castillo Terrones filed an annulment appeal before the Public Ministry requesting that the decision to investigate the president without suspension be annulled and a new provision be issued, arguing that the “Magna Carta prohibits the persecution of the President of the Republic -in office- in cases not provided for in its article 117″.
In said request, it was argued that, according to the Political Constitution, an acting president can only be investigated when any of the assumptions concur.
