Pedro Castillo: reject habeas corpus against denunciation of treason against the country in Congress

The Judiciary rejected in first instance the petition for habeas corpus presented by the president’s lawyer that sought to annul the process initiated in the Subcommittee on Constitutional Accusations of Congress for alleged treason against the country.

The Ninth Specialized Constitutional Court, in charge of magistrate Juan Fidel Torres Tasso, rejected the appeal in which the president’s lawyer requested that the entire case initiated based on the accusation presented by a group of lawyers headed by Lourdes Flores be annulled and later assumed by legislators such as Norma Yarrow (Avanza País).

Eduardo Pachas proposed that the decision made on February 28, 2022, in which the constitutional complaint for treason be declared admissible, be annulled.

The judge assessed that, although the lawyer for the head of state assured that the presumption of innocence and freedom of expression of Pedro Castillo had been violated, the admission of the constitutional complaint respected the procedures established in the regulations.

“(The decision) is given within the framework of the functions of political control established in the Political Constitution of the State for the Legislative Power and respect for the parameters that are appropriate to the political control of those who matter to the public interest”reads the court decision.

The resolution issued on April 8 in this first instance details that, since the specific steps of the complaint still need to be carried out in the Permanent Commission, the investigation in the Subcommission and later in the plenary session of the Legislative Power, the rights of Pedro Castillo.

“There is no certain and imminent threat of infringement of the constitutional rights to due process, to the principle of legality, or the right to defend rights related to individual freedom”determines Judge Torres.
