President peter castle ruled on the recent ruling of the Constitutional Court that returns the pardon to the former president Alberto Fujimori. Through his Twitter account, the president considered that this ruling is the reflection of an “institutional crisis.”
In addition, the president referred to the international justice bodies in order to “preserve the effective exercise of justice”, alluding to the Inter-American Court of Human Rights (IACHR) in reference to this ruling.
As is known, the Constitutional Court (TC) today granted the habeas corpus presented in favor of the former president Alberto Fujimori to annul the judicial rejection of the pardon. In this way, according to sources from Peru21, the former president will recover his freedom.
Judge Ernesto Blume had presented a paper on the case, concluding that it was appropriate to accept the appeal filed by citizen Gregorio Parco Alarcón.
According to the sources consulted, the vote for the presentation was 3-3: Blume, José Luis Sardón and Augusto Ferrero voted in favour; Marianella Ledesma, Manuel Miranda and Eloy Espinosa-Saldaña opposed. Given the tie, Ferrero’s casting vote as president of the TC defined the result 4-3.
This sentence restores the humanitarian pardon in favor of Fujimori that was granted by former President Pedro Pablo Kuczynski on December 24, 2017. On October 3, 2018, Supreme Judge Hugo Núñez annulled the presidential grace granted by Kuczynski, a decision that forced Fujimori to return to prison.
In 2009, the former head of state was sentenced to 25 years in prison for the murder of citizens in the Barrios Altos and La Cantuta cases. The sentence will be fulfilled in the year 2034.
