AYesterday, Supreme Decree 022 was published, which modifies the statutes of said private institution, which is currently in the hands of the CEN-Sutep, arbitrarily.
The rule bears the signatures of the president and his Minister of Education, Rosendo Serna.
The Spill board is currently made up of four representatives from CEN Sutep, one from the Union of Teachers of Higher Education (Sidesp) and one from the Ministry of Education (Minedu). Supreme Decree 022 intends that there be a board of directors made up of seven associates (appointed teachers) who teach in educational institutions of basic education, two associates of IE of Higher Education, an association that teaches in a Productive Technical Education Center (Ceptro), two associates who are auxiliary and one who represents the Minedu.

Likewise, the board of directors will be elected in elections among the associates, with the participation of ONPE. The problem is that in the first elections, by exception, the process will be directed by the Minedu. Likewise, it will be the Serna portfolio that approves the complementary provisions for the management of the Spill.
In this way, the Castillo government seeks to exclude CEN Sutep, the old rival of Fenate-Peru, union promoted by the president, in control of the teachers.
For the secretary general of the sutepLucio Castro, this it is government interference because the DM is a private institution that does not depend on the power of the day. “This expresses the use and abuse of power, because the political purpose of the organizations to which the president belongs, in the spirit of destroying Sutep, is to target Spill,” Castro said.

For his part, Ronald García Salcedo, Secretary of Defense of Sutep, considers that DS 022 goes against constitutional rights. “Of course, the government always had the intention of taking over the Spill because those who used to be called Conare are there in the Executive, and who are now Fenate – PeruGarcia said.
In the leadership of Sutep, it is worrying that the process of electing the board of directors of the DM is under the tutelage of Minister Serna, who is also against the teachers’ union of Patria Roja. That, they added, goes against the democratization of the Spill announced by the president.
A plan dating back years
In 2017, Conare-Sute began a teachers’ strike, led by the then union leader Pedro Castillo. Among their demands was to have participation in the direction of the Teacher Spill.

That stoppage reflected the conflict between Conare and CEN Sutep. One of the opponents of Castillo’s radical faction was precisely Luis Espinoza, at that time secretary of Pedagogical Affairs of Sutep, who was attacked by the president’s guild. Espinoza is currently the director of the Spill.
The Castle Strike it did not obtain substantial improvements in education nor in the working conditions of teachers. However, it marked the beginning of the Cajamarcan teacher’s political project: to create a union that would allow them to interfere in the DM.
In 2021, a few months after assuming the presidency, the Castillo government, From the office of the former Minister of Labor, Iber Maraví, formalizes the creation of Fenate Peru, a union made up of his former colleagues from Conare, including Mery Coila, linked to Movadef.

In that period, the congressman from the Magisterial Bloc, Edgar Tello, one of the president’s bishops, asks the then Minister of Education, Juan Cadillo, for information about the Spill. In the same way, the parliamentarians who represent the interests of this union have presented, up to now, seven bills related to the management of the DM.
Of these legislative proposals, five are for changing the composition and choosing the directory and two are to empower appointed teachers to withdraw their funds.
But as he Magisterial Block does not have the support in Congress to achieve its goal, the Executive opted for a supreme decree. At no time, Castro and García affirmed, was the Sutep leadership summoned by the Minedu to discuss this issue. Everything was machined unilaterally.

García reiterated that, according to the regulations of the DM, the only ones who can modify the statutes are the members of the board of directors, not the president and less a minister.
What comes now is a legal battle. The CEN Sutep will not allow the government to interfere in the management of the Spill. In fact, as García assured this newspaper, they are evaluating resorting to the Judiciary and the Constitutional Court to resolve this controversy. “Constitutional rights are protected by amparo action,” he reiterated.
If the Castillo government achieves its mission, they assure CEN Sutep, his union will manage the millionaire coffers of the DM for the political purposes of Conare, currently called Fenate-Peru.

The Teaching Spill receives the contribution of 0.5% of 1 UIT of the salary of each teacher name of the country. There are around 250 thousand teachers who are associates of this institution.
The Crisol bookstore network and the Minka Shopping Center belong to the Magisterial Spill.
This institution also offers different types of loans to its associates. Likewise, the contributions are returned when the teacher retires.
