Benji Espinoza, lawyer of peter castlehad anticipated that the head of state would not go to testify at the headquarters of the Public Ministry, given that the president could receive the Nation’s prosecutor, Patricia Benavides, in the presidential office.
“The prosecutor of the Nation incurs a legal error because the president cannot be forced to go to the headquarters of the Public Ministry. Article 167 (…) says that when the president declares, he acts by choice if he declares in his house, domicile or office. He does not have the obligation to go to the Public Ministry, ”said the lawyer.
“The Constitution in article 117 has not established neither the possibility nor the procedure for a president to be investigated. The law establishes a procedural privilege to choose the place of the declaration and the president has the right. He cannot be forced to define where he is going to testify,” added Espinoza.
Meanwhile, from the Prosecutor’s Office they requested that Pedro Castillo go to the headquarters to testify about the irregularities in the promotions of the Armed Forces.
