benji espinozaattorney for the president peter castlespecified that his client never mentioned that he would collaborate with the investigation that follows him, but said that he would do so with the investigations of third parties in which he is a witness.
In statements to Canal N, he explained that the process currently being carried out against Castillo Terrones is illegal, so the president cannot provide facilities for it. Along these lines, he said that he would do it with the investigations “that are constitutional.”
“What must be understood is that collaboration must be done within the constitutional framework. The collaboration that the president offers is as a witness in the different investigations where they ask for his statement”affirmed the lawyer.
“[¿Entonces colabora con las investigaciones de los demás?] Collaborate with all the investigations in which they ask for your statement”he expressed.
“What sense would it make to present a protection of rights, if you are going to submit to an unconstitutional investigation, it would not make sense”, Spinoza added.
“There is no contradiction, because if you acquiesce to an unconstitutional investigation, you submit, and we cannot allow that, but in the other investigations, generally in the plural, which are diverse, the president collaborates in those investigations, that is the reference of the president”accurate.
“[¿Entonces lo que ha dicho es que va a colaborar con otras investigaciones?] Of course, in the investigations that are constitutional”held.
It should be noted that, last Sunday, President Castillo Terrones stated on TV Peru that he would collaborate with the investigations, without specifying whether he was referring to the process in which he is involved as a defendant or to those in which he is a witness.
“[Estoy] totally willing, I am going to collaborate, I am going to attend the call that is being made not only by the prosecutor [de la Nación]but other instances that have to do with the investigation”, said the head of state.
At another time, lawyer Espinoza asserted that this Thursday they will define the way in which President Castillo will give his statement to the Public Ministry, since he stated that there are three paths: that the prosecutor appears at the Government Palace, that the president attends the Public Prosecutor’s Office or to have the questions sent to him in writing. It should be noted that in the latter case there would be no room for cross-examination.
“There are three scenarios, the decision has not been defined. If the protection of rights gives us the reason, that citation is without effect. Tomorrow we will define it”, said.
