THE Proposed Amendment to the Constitution (PEC) that ends the reelection For President of the Republic, governors and mayors was read on Wednesday (23) at the Senate Constitution and Justice Commission (CCJ). A request for view postponed the vote for May 7th. 
PEC provides for a transition rule with the end of reelection only for those elected in 2034; Extends the executive’s mandates from 4 to 5 years, including federal, state and district councilors and deputies, and unifies all elections for the same year. Instead of elections every 2 years, Brazil would have elections every 5 years. Mayors and councilors elected in 2028 would have a term of 6 years, without the right to reelection. The senators would have the expanded mandates from 8 to 10 years.
No senator spoke out against the end of reelection at the CCJsuggesting consensus for the proposal. However, the transition rule was criticized with a request for the end of reelection to the elected as early as 2026.
The rapporteur of the article, Senator Marcelo Castro (MDB-PI) (photo), justified the measure arguing that reelection harmed Brazil.
“Instead of enabling voters to have a successful officers’ option, contributing to improve the quality of the mandates, reelection resulted in a pernicious bias, stimulating the chiefs of the executive branch by the option of immediate, easy -to -return immediate agendas, to the detriment of long -maturation structuring projects, although preferable,” explained Castro.
The possibility of reelection was included in the country in the first government of Fernando Henrique Cardoso in 1997, a change that allowed the politician’s reelection in 1998.
Senator Omar Aziz (PSD-AM) maintained that it is better to end reelection because up to 2034 new legislators can change the rule again.
“If we are waiting 2034, no one knows if we will be here yet. Reelection in the country was the worst thing we could have done to Brazil, to Brazilians, to governments, because the guy goes to a reelection, and makes crazy to reelect. If he misses, he delivers the wide government to the successor,” he says.
Rapporteur Marcelo Castro suggested the possibility of an agreement to anticipate the end of reelection to the elected in 2028.
“We can come to an understanding and shorten a little [a regra de transição]. The principle I drew was not to hurt the acquired right, and even the expectation of law. But we can reach an agreement. ”
Amendments to PEC were presented to reduce the number of senators to two per unit of the federation. Currently, there are three by state. Another amendment requested the reduction of senator mandates from 10 to 5 years. But the proposals were rejected by the rapporteur, arguing that there is no consensus and debate enough to reduce the time of the mandates or the number of senators.
“The debate about the reduction of senators’ mandates is insufficient to build a minimum agreement on the matter,” he said.
