“I am going to work with my team on a constitutional complaint against the Attorney of the Nationbecause we consider that it is violating the Political Constitution of Peru. We believe that, at a minimum, you should have reviewed article 93 of the Constitutionwhich establishes the inviolability of our vote and the prerogatives we have to exercise it appropriately and correspondingly,” said Juárez.

The congresswoman explained that her support for the opinion of the Defense Commissionwhich gave rise to the constitutional complaint against him and against other colleagues, was based on a previous ruling issued by the Constitutional Courtl: “This opinion of the Defense Commissionand, subsequently, the law was approved in accordance with a ruling of the Constitutional Courtwhich, in other cases, determined that, due to the nature of pensions, it is possible to receive income simultaneously. The TC considered that pensions constitute personal savings – in this case, of the military – and have a different nature from income from the State. This motivated the decision, not only for the military, but for all similar cases, in which retirement pension and state remuneration could be received.”

The National Prosecutor’s Officethrough his Enrichment and Constitutional Complaints Areapresented on Tuesday, January 22, a constitutional complaint against the congressmen José Williams, Jorge Montoya, Roberto Chiabra, José Cueto, Alfredo Azurín, Hamlet Echevarría, Américo Gonza, Patricia Juárez, Juan Lizarzaburu, Pedro Martínez and Lucinda Vásquez. All of them are accused of being allegedly responsible for the crime of incompatible negotiation, to the detriment of the State.

According to information obtained by The Republicthe aforementioned congressmen would have exerted undue influence to approve the opinion of bill 319-2021. This ruling allowed José Williams Zapata, Jorge Montoya, Roberto Chiabra, José Cueto and Alfredo Azurín simultaneously receive a double salary and pension income, despite performing parliamentary functions in Congress. The situation occurred while the congressmen were part of the National Defense Commission, Internal Order, Alternative Development and Fight against Drugs during the 2021-2022 legislative period.
“They can access the receipt of salary and pension simultaneously, without any restriction or limit on the total amount, due to their dual status as public officials in charge of popular election and pensioners of the Armed Forcess”, details the statement from the Public Ministry.
