This after the National Justice Board (Jnj) acquitted the observations that the prosecutor of the nation, Delia Espinoza, formulated before executing the reinstatement of Benavides to the institution.
On July 31, the Permanent Criminal Chamber of the Supreme Court annulled the 24 months of suspension that the Supreme Court of Preparatory Investigation imposed on Benavides Vargas following the investigations that are followed against him in the case “Los Cuellos Blancos”.
In the resolution of the Supreme Chamber that raided Benavides’ return to the Public Ministry, it was indicated that it was not possible to suspend it in the position of prosecutor because Congress had not authorized the opening of a criminal case against him.
And although after the ruling of the Supreme Chamber, it corresponded that the JNJ ordered the replacement of Benavides, this step was expanded because Espinoza Valenzuela asked the entity responsible for appointing and dismissing the judges and prosecutors to clarify the “inconsistencies and irregularities” in the attempt to return Benavides to the ownership of the Prosecutor’s Office of the Nation.
It is in that context that the public prosecutor’s former sued that he was reincorporated in his position as a supreme prosecutor.
“Knowing by the media that the JNJ has acquitted the consultations made by the Prosecutor of the Nation, in order to issue the execution of his decision to restore me in the position of Supreme Prosecutor, it is up to me to immediately be cured the respective citation for my reinstatement,” he said in the statement released by his lawyer, the former congressman Jorge del Castillo.
