Ortega will reform the Constitution and Police Law to “legalize the police state and repression” says CETCAM

The dictators Daniel Ortega and Rosario Murillo have ordered the reform, in the National Assembly, of the Political Constitution of Nicaragua and the Police Law to legalize the repression and surveillance of the people of Nicaragua, and put the institutions at the service of a police state already in place, says an analysis released by security specialist Elvira Cuadra.

Cuadra, director and researcher at the Center for Transdisciplinary Studies of Central America (CETCAM), points out that the reform initiatives to the Political Constitution of Nicaragua and the Law of Organization, functions, career and special regime of Social Security of the National Police, or law 872, which could be approved in the ordinary session of the Legislature this Wednesday, July 5, completely change the nature of the police institution.

The researcher affirms that the police state is being “institutionalized.” And this phenomenon has two aspects. The first is “a change in the legal framework of the country, in order to legalize a series of measures, security policies, of a repressive nature and surveillance of the entire Nicaraguan society.”

The second aspect, indicates the specialist, has to do with a modification or reconfiguration of state institutions so that they respond to that legal framework that legalizes repression.

Remember that the current Police Law and Constitution state that the Police is “an armed body of a civilian nature”, which changes significantly with the proposed reform, both in the Constitution and in the Law, because it eliminates “the Civil nature” and the it leaves only as “an armed body.” He warns that this speaks of an institution “with a form of organization, with a completely different type of function and structure.”

He warns that after the reform “preeminence” will be given to the direct subordination of the Police “to the figure of the Presidency” and the preventive, proactive, community model, which highlighted the participation of people, is set aside.

Another warning highlighted by the expert on security issues is that the reforms proposed by the regime emphasize, mainly, “the mission, the function, related to preserving the social order, the internal order, talks about protecting the lives of the inhabitants and speaks of ensuring national, social and private goods, as well as the prevention and prosecution of crime”.

Likewise, it reiterates that they modify the constitutional mandate that orders the Police to be “professional, apolitical, non-partisan, obedient and non-deliberative” and that makes the Police “prone to orders that emanate directly from the Presidency, without any kind of principle , nor doctrine that can stop the centralized provisions from the Executive ».

Similarly, Cuadra calls attention to the fact that the reform to the Police Law adds “sanctions or punishments” to those police officers who do not comply with the orders of their superiors or who decide to desert the institution.

«The explanation that we can find for these additions is that, in the face of desertions, escapes and discontent within the institution, they are trying to introduce disciplinary measures to put pressure on the same troops and that the apparatus police force is not reduced in number or in its capabilities,” the analyst concluded.
