Ordinance exempts employer from registering PPP on eSocial in 2022

THE Official Diary of the Union This Friday (18) published Ordinance 334/22, which exempts companies, until the end of this year, from reporting the events S-2220 (Worker Health Monitoring) and S-2240 (Environmental Conditions at Work – Harmful Agents) in eSocial – computerized public administration system. According to the Ministry of Labor and Social Security, the change is intended to provide legal certainty to all companies in the implementation of the so-called PPP – Social Security Professional Profile – in electronic media, in addition to guaranteeing the time needed to adapt to this new form of document preparation. The implementation of the PPP exclusively in electronic media is scheduled for January 1, 2023.

“We are going to give more this year so that companies can prepare, especially micro and small companies. It is assured that, until January 1, 2023, nothing changes in relation to the issuance of the PPP. It continues to be done on paper in the same way it is done today, without any change in the rules currently in force”, guaranteed the Minister of Labor and Social Security, Onyx Lorenzoni.

Necessary adjustments

By the ordinance, the National Institute of Social Security (INSS) must promote the necessary adjustments in the PPP so that the document can be available in electronic media on the day it begins to be mandatory, ensuring that the worker can directly access their information on the digital channels of the institute, avoiding the need for the employer to issue the document on paper.

With the change, the federal government’s expectation is that the electronic PPP will increase legal certainty for companies and reduce the judicialization of the special retirement benefit. Among the advantages of electronic implementation are the computerization of processes, which are currently manual within the scope of Public Administration, more security in the storage of information and improvement in the quality of information available for inspection.

Historic

The Social Security Professional Profile started to be required by Social Security for proof of time subject to special working conditions as of January 2004, in physical media (paper). In June 2020, the PPP forecast in electronic media was incorporated into the Social Security Regulation (RPS) .
