The Judicial Disciplinary Court (TDJ) of the Judicial Branch of the Federation (PJF) published in the Official Gazette of the Federation (DOF) an agreement that determines the frequency and type of sessions of the plenary session and commissions, including ordinary, extraordinary and solemn sessions, as well as the protocols for the approval of minutes and votes.
It points out that the provisions of this order are of general observance in the TDJ, corresponding to its presidency, magistrates and persons holding auxiliary bodies and administrative areas to ensure their due compliance and are intended to define the number and times of sessions both for the plenary session and for the work in its commissions, as well as the frequency with which they will be carried out and the conditions under which they will be developed.
It indicates that the TDJ will have two ordinary sessions each year: the first will begin on the first business day of January and end on the last business day of the first fortnight of July, and the second will begin on the first business day of August and end on the last business day of the first fortnight of December. In any case, the report referred to in section 13 of article 154 of the Organic Law of the PJF must be submitted by the person who presides over the court no later than this last date.
It details, among other things, that matters within the jurisdiction of the full court will be resolved by unanimity, a qualified majority of four votes or a simple majority of votes, in the terms established by the Organic Law.
Provisions for absences
In the event that the holder of the presidency is absent during the development of a session, it will be presided over by the magistrate that has obtained the greatest number of votes in the respective election that is part of the plenary session at that time.
In the event of the absence of the rapporteur, any other judge who agrees with the meaning of the draft resolution presented may adopt it and make the respective addition. In any of the above cases, the reasons for the absence must be justified.
In a second agreement, the TDJ approved the structure of the Administrative Responsibilities Investigation Body, which is in charge of investigating serious administrative offenses.
Its structure is made up of the head of the administrative responsibilities investigation body, the general investigation direction, the general opinion direction and the agreement review area.
