The parties of the Dominican Liberation (PLD), Force of the People (FP), Dominican Revolutionary Party (PRD) and Broad Front (FA) announced this morning that they will reject in the Chamber of Deputies the Bill of Extinction of Domain approved in the Senate, because it collides with principles established in the Constitution of the Republic.
José Dantes, legal director of the PLD, said that its legislators will vote unanimously against the piece; while Rubén Maldonado, spokesman for the FP, and Juan Dionicio Rodríguez, from the Broad Front, said that they will ask the plenary session of the Chamber of Deputies to make it known as an organic law and to eliminate the principle of retroactivity, which is prohibited in the Magna Carta.
They agreed that if it becomes law, the initiative would be declared unconstitutional by the Constitutional Court.
Dantés explained that the PLD agrees with the existence of the domain extinction law in the country, but not under the conditions that the Modern Revolutionary Party (PRM) intends to pass it, which, in his opinion, violates the Constitution and endangers the right ownership and legal certainty in the Dominican Republic.

On his side, Deputy Maldonado, of the People’s Force, said that this party will not support the bill on domain forfeiture trials, if it violates constitutional principles.

He announced that they will request that in the plenary of the deputies it be known as an organic law, which implies that it would have to be approved with a qualified vote of two thirds of those present in the session.

The spokeswoman for the Dominican Revolutionary Party (PRD), Fiordaliza Peguero, said that they support the approval of a domain extinction law that, due to its organic nature, clearly guarantees the right to the principles of the non-retroactivity of the law and the presumption of innocence. These principles are protected in the Constitution.
“In that same order, our party considers that the law under discussion must observe the protection of the right to property, under the conditions established by Article 51 of the Constitution, in addition to a 20-year statute of limitations.
The deputy reported that the PRD is willing to work together with the other political forces in building a consensus in the approval of a domain extinction law that does not violate any fundamental right guaranteed in the Magna Carta.
