A 10-year-old girl became pregnant as a result of sexual rape, which occurred in December of last year in the province of Camaná. The situation put the health of the pregnant woman at risk, so the Medical Board was called to evaluate the possibility of terminating the pregnancy; However, it was not proceeded due to the gestation period.
The fact became known on December 18, 2025, but only on On January 9, the evaluation was carried out, obtaining said recommendationwhich states that the application of the “National Technical Guide for the Standardization of the Procedure for Comprehensive Care of the Pregnant Woman in the Voluntary Interruption for Therapeutic Indication of pregnancy under 22 weeks with informed consent within the framework of the provisions of Article 119 of the Penal Code” was not appropriate for this type of case, in addition to not having been requested by her or her representative.
In this regard, the Ombudsman’s Office recalled that the Health Establishment (EESS) has the obligation to inform the pregnant woman of the procedure and proceed ex officio in the event of a risk for comprehensive health, especially in situations of sexual violation, without waiting for a formal request.
Therefore, he urged the Ministry of Health to guarantee specialized medical care and follow-up for the pregnant womanwhose body is not biologically prepared for pregnancy. Furthermore, the Vice Ministry of Public Health is urged to immediately arrange the corresponding investigations, in order to determine functional responsibility.
