The Ombudsman He rejected and expressed his concern regarding the Executive’s bill that proposes that the dissemination of confidential information in criminal investigations be sanctioned.
The institution assured that this approach would be seeking to inhibit the collaboration of the people who provide this kind of information to the media to disseminate it to the public.
“The Ombudsman’s Office expressed its concern at the announcement of the presentation of a bill that proposes penalizing anyone who reveals information on tax investigations. for the institution, This proposal would seek to inhibit the collaborative work of those who provide essential information to journalists, thus affecting freedom of expression and the citizen’s right to information.”, he indicated.

In this sense, the entity emphasized that it is essential to ensure the minimum conditions that allow journalists to fully carry out their work, since it indicated that this guarantees that Peruvians are informed and their participation in public is encouraged.
“Such conditions could not be achieved in contexts in which disclosure of tax information is criminalized, as it intimidates journalistic sources.preventing or making it difficult for the press to access reliable information on matters of relevance and public interest”, added the Ombudsman.
Likewise, it maintained that, despite the fact that the norm indicates that the investigations must be reserved, it has to weigh according to the principles and rights “that are the basis of a democratic constitutional system, such as the principles of transparency and maximum publicity of State actions”.
Finally, the The Ombudsman’s Office requested the Executive Power to discard the presentation of that initiative and that promotes the approval of regulations that ensure journalistic work.
