Ombudsman promises to promote annulment of sanctions for homosexuality in the FAN

The Ombudsman, Alfredo Ruiz, dismissed the complaints of Lgbti activists, three of them chained in front of the Ombudsman’s office since Monday, November 21, and asserted that his management has acted in favor of this sector of the population. The official only promised to review two demands from the community: the annulment of article 565 of the Organic Code of Military Justice and the recognition of the name change for gender reasons. He did not comment on marriage equality and the adoption of same-sex families.


The OmbudsmanAlfredo Ruiz, promised to promote the modification or annulment of article 565 of the Organic Code of Military Justice, which penalizes homosexual relations within the National Armed Forces (FAN).

The statement was made on the afternoon of November 23, at the Ombudsman’s office in Caracas, after a group of LGBTQ activists chained themselves indefinitely and threatened to go on a hunger strike to protest the lack of responses. of the State to their demands on the change of name for gender reasons, discussion in the National Assembly of a bill on equal marriage, the annulment of this article of the Code of Military Justice, as well as the evaluation of the adoption of homoparental families .

Ruiz said that the Ombudsman will verify the demands that have been made before the Supreme Court of Justice (TSJ), among them to demand recognition of trans people and to request the repeal or annulment of article 44 of the Civil Code, which establishes that marriage can only take place between a man and a woman.

The official indicated that he will also verify the complaints about access to the right to change the name established in the Civil Code. In his statements he did not set a period of time to obtain results. He pointed out that everything will depend on the complaints that the community sends to his office.

The activists Kody Campos, Javier Ávila and Paul Martucci have been chained since Monday, November 21, in protest against the inaction of this organization in response to requests from the Lgbti community. After the declarations of the Ombudsman, they said that they will not withdraw from the site and give the official a period of one week to obtain answers to their demands.

If they do not obtain a new pronouncement, they promise to start a hunger strike. The activists demanded that the State fulfill its constitutional duty and accompany the demands of human rights defenders.

During his press conference, the Ombudsman dismissed the complaints from Lgbti activists and asserted that his management has acted in favor of this sector of the population. He pointed out as achievements the creation of the Special Delegate Ombudsman for the Protection of the Diverse Sex; however, he avoided answering about the progress of this office.
