The Ombudsman’s Office decided not to admit the complaint against the José Domingo de Obaldía Maternal and Child Hospital and the Raúl Dávila Mena Hospital (Changuinola Hospital) of the Social Security Fund, for the alleged disappearance of twins, given that in the steps it took the entity to corroborate the veracity of the facts, the existence of the same complaint was verified in the Public Ministry (MP) dated May 26, 2021 and in the same file the complainant retracts, a day later citing personal reasons.
The Ombudsman’s Office as the guarantor of the human rights of all the country’s inhabitants, since April 13, set out to reach the material truth for the opening of the complaint, however, due to the lack of grounds, the complaint is rejected and your file is sorted.
During the investigative process, the Ombudsman’s Office verified that the criminal case was registered in the Early Decision and Litigation Section, which indicates that there are no statistical records in the José Domingo de Obaldía Maternal and Child Hospital for childbirth, ambulance, emergency , neonatology, hospital morgue, fetal death and abortion books; as well as births or clinical reports as reported by the complainant.
In addition, the file shows that one day after filing the complaint in the MP, on May 27, 2021, the complainant retracts the facts and informs the judicial authorities of her reasons for which she had to lie, therefore the cause criminal case was filed in September 2021 and a case is opened against the complainant for the alleged crime with the administration of justice with the modality of simulation of punishable acts and slander in judicial proceedings.
The National Human Rights Institution of Panama, in its resolution, recommends that the complainant seek assistance from entities such as the National Institute for Women (INAMU), to help her overcome the vivid experiences.
The Ombudsman’s Office urges any person who considers that their human rights have been violated, to go to the entity responsibly without undermining the honor of third parties.
