The Ombudsman, Josué Gutiérrezpronounced the lawsuit against Legislative Decree 1373 that presented to the Constitutional Court. The norm grants autonomy to the judicial processes of domain extinction and will be evaluated this Thursday, February 20.
Gutierrez has been questioned for seeking the nullity of the norm because his sister’s vehicle, Sara Gutiérrez, was seized, because he linked to the crime of smuggling. Given this, the head of the Ombudsman denied that his lawsuit seek to benefit his relative.
“That is false. […] When we submit a demand for unconstitutionality, we do it in the beginning of constitutional control that the Court must exercise, which is the maximum interpreter of the Constitution. So, we are actuating, we are not the ones who solve, “he said in RPP.
The Ombudsman said he had not had knowledge about the legal measure that weighs on his sister’s car when he filed the lawsuit.
“I didn’t know, in honor of the truth, and I can, at the moment, give my word that I did not know about that process,” he said. In addition, he indicated that “it would be illegal” if he uses his position to advocate for a “particular case.”
“It would be illegal or, at least, lack of ethics if one focuses on the knowledge of a particular case. (…) The Ombudsman, by constitutional mandate, is obliged to exercise the defense of the Fundamental rights of people and the community.
