On November 20, the Ombudsman’s Office sent the TC a 23-page document exposing its support for the habeas corpus of Urresti’s defense, who assures that the principle of res judicata has been violated by holding two trials for the same facts, since previously the head of the Castropampa Barracks when the crime occurred, Víctor La Vera Hernández, and the then officer Amador Vidal Sanbento had been convicted. However, it is worth mentioning that the latter stated that Urresti participated in the murder of Bustíos.
He even claims that the principle of equality before the law has been violated because both La Vera and Vidal were prosecuted for the common crime of murder with great cruelty (since after shooting the journalist, they blew up his body with a grenade), and Urresti was convicted of a treacherous crime and “the crime against humanity was instrumentalized.”

In conversation with La República, Sharmelí Bustíos indicated that “the request of the Ombudsman is outrageous, and takes this institution to the darkest spaces, when this entity was created to defend us, but is now kidnapped by a nefarious power that knows no limits and obeys political reasons.”
“At a legal level, Daniel Urresti’s responsibility in the murder of my father has been demonstrated. Attempting to question that sentence, arguing that due process has not been respected, that the crime should not have been classified as a crime against humanity, ignoring what it meant to practice journalism in the era of violence, when there was a systematic violation of human rights, has no name,” he said.
