Judges Orlando Abril, Luis Madariaga and Manfred Vera imposed this afternoon unanimously 6 years of effective prison against the provincial mayor of Arequipa, Omar Candia Aguilar, for the crime of aggravated collusion due to the irregular acquisition of 40 security cameras when he was mayor of Alto Selva Alegre in 2012.
After more than 10 years of proceedings, the judges agreed with the anti-corruption judge Edy Leva, who this year, in first instance, found Candia guilty and imposed 6 years in prison.

In part of the reading of the sentence, magistrate Orlando Abril explained 4 reasons that supported his decision.
1. Procedural consistency. Candia’s lawyer and the other defendants observed that the sentence issued by Leva lacked this principle. However, April referred “In the analysis of the sentence, the written content of the accusation has been made, where it has been verified that there is an imputation of the facts that have later been the subject of prosecution. The magistrate continued “(The judge) has not exceeded procedural consistency (…) has resorted to circumstantial evidence, which existed of an unknown fact.”
two. Questioning of evidence. The presentation by the Prosecutor’s Office of evidence such as the recruitment 04-2011, which also referred to the purchase of security cameras. This call was canceled due to the disappearance of the needbut after them opened the contracting process 01-2012 (irregular purchase of care in court). 3. technological variation. The cameras would have a technology of radio link that later switched to fiber optics. “From the formal point of view it was better, however the study on which the attributed change in technology is based is unknown,” the judge specified.
Four. Type of turnkey contract. The purchase of cameras was made under the turnkey modethat is, the contractor is in charge of both the design and execution of the entire project. In other words, the product will be ready for immediate use.
However, Judge Abril warned that “At the time of the inauguration in October 2012, the works were not completed, which has a significant impact on establishing the collusive agreement.”.
