One of the most emblematic cases of political financing in the country will be resolved on Tuesday. The Judiciary will issue the judgment of the trial for money laundering against the former president Ollanta Humala and the former first lady, Nadine Heredia, for the alleged contributions received by the Nationalist Party in the 2006 and 2011 campaigns.
The hearing will be this Tuesday 15 of the present (09:00 hours.) In Judicial Headquarters Carlos Zavala Loayza.
The decision of the third collegiate court of the National Superior Court could place Humala as the third constitutional president of our country convicted of corruption already Heredia as the only former first lady sentenced to prison.
A conviction, in addition, could redefine the receipt of unstalled campaign contributions as a crime of money laundering.
The accusation, presented by prosecutor Germán Juárez of the Special Lava Jato team, argues that the campaigns of the party that nominated Humala in 2006 and 2011 received illicit funds from Venezuela and Brazil.
In the first, according to the testimony of exassor Martín Belaunde Lossio in the oral trial, the government of Hugo Chávez would have sent money through diplomatic suitcases.
“Sometimes (money) came for diplomatic suitcases and other times I don’t have certainty how, but they gave it to me in cash, in two backpacks,” said the businessman, who said that money came from illicit businesses that were made between entrepreneurs “and the entrepreneurs gave money.”
“Obviously, it was an illicit money because it was money that came from businessmen from the Venezuelan government and came in a surreptitious way and tried to bleach here through ghost contributions and through my even, to create these companies or these fictional contracts,” Belaunde said.
He clarified that Venezuela’s money was mostly used for the campaign and what was left over was for television teams, to see this press issue and the fictional contracts that were made.
For the 2016 campaign, which meant the electoral victory of Humala, the aid would have arrived from the surroundings of the then Brazilian president, Lula da Silva.
Humala and Heredia have denied all the charges. They have insisted that the campaigns were financed with legal contributions, and that there is no evidence that money has been illicit. His defense maintains that the existence of the source crime has not been proven – that is, the illegal origin of money – and that the whole process has been a political and media persecution.
They have also questioned the validity of Heredia Agendas as evidence and have indicated that the accusations are built on testimonies of effective collaborators seeking judicial benefits.
The Public Ministry has asked for 20 years in prison for Humala and 26 years and a half for Heredia. In addition, he has requested sentences of up to 26 years and a half for eight others involved, the dissolution of the Nationalist Party and the entire Graph, and a civil reparation of S/ 20 million.
During his final allegations the former president lashed out against the Prosecutor’s Office, accusing her of having double standard with the executives of Odebrecht and OAS.
“The cheap Mr., the executives of Odebrecht and Oas have not put anything in them, so they are not in Peru today, they have taken their money and have arranged their properties. Curious thing, double standard of the Prosecutor’s Office,” he said.
Heredia also denied having received money contributions in the two presidential campaigns and described as revenge the statements made in the trial for Belaunde and accused of persecution and discrimination against their political adversaries.
