OEV highlights that they have not appointed the person who will replace Tania D’Amelio in the CNE

CNE resumes union and trade union administrative procedures, but maintains electoral delay

According to the OEV, this should be a substitution of a simple procedure, without the intervention of a public power fund or any authority. This is because the former main rector keeps two alternate rectors in force


D’Amelio was designated as the second among the three main electoral rectors that civil society nominated

Since the National Assembly of Nicolás Maduro appointed Tania D’Amelio as a magistrate of the Supreme Court of Justice, the person who occupies her position in the National Electoral Council (CNE) has not been appointed.

This was warned by Venezuelan Electoral Observatory (OEV). From April 26, until June 20, 55 days have passed since the appointment of D’Amelio as a magistrate.

According to the Organic Law of the Electoral Power (LOPE), the replacement should be automatic, without the need for any additional decision.

Article 13 of the LOPE states the following:

“Each member of the National Electoral Council will have two alternates from the sector that nominated him or her and they will be numbered in ordinal sequence. The main ones from applications made by civil society will be replaced in the following way: the first or first designated or appointed principal will have the first (1st) and second (2nd) alternates; the second or second principal designated or designated will have the third (3rd) and fourth (4th) alternates; the third or third principal designated or designated will have the fifth (5th) and sixth (6th) alternates.

The substitutes will cover the temporary or absolute absences of the corresponding electoral rectors”.

During the reading of magistrates, D’Amelio was designated as the second among the three main electoral magistrates that civil society nominated.

In that sense, it has the third and fourth as alternate rectors, namely, Leonel Párica Hernández and Rafael Chacón Guzmán.

In addition, Párica and Chacón, in that order, were also assigned to D’Amelio in the Electoral Gazette No. 972 of May 6, 2021.

The replacement

In addition to being rector of the CNE, Tania D’Amelio also served as president of the National Electoral Board and member of the Civil and Electoral Registry Commission.

Based on the above, it is the first substitute of the missing rector who must cover his absence.

According to the OEV, this should be a substitution of a simple procedure, without the intervention of a public power fund or any authority. This is because the former main rector maintains her two deputy rectors in force.
