The Public Ministry claims to have elements to accuse Rafael Esquivel, alias Mbururu, for the alleged sexual abuse of a minor. The senator-elect is exposed to 15 years in prison.
The Prosecutor Vivian Coronel referred to Radio Monumental that Rafael Esquivel, alias Mbururu, complies with the preventive detention measure, due to the accusation against him for sexual abuse of a teenager. “He faces 15 years in jail”, he added.
He said that there is an atypical case now with this activist, since he was charged before being elected as a senator. “I don’t know if you can take an oath from your place of confinementbut he was already deprived of his liberty before being elected senator,” he explained.
The investigative stage is in its conclusion stage and the accusation will be presented in a short time before the courts, according to prosecutor Coronel.
Mbururu has been in jail since last August and, despite this, he managed to enter the Senate with 51,397 votes.

“The procedure that the law says is going to be done, I do not want to refer to that yet, because, in addition to administrative functions, as ministers we also have jurisdictional functions, and if I give my opinion, it could be grounds for recusal,” he said. the minister of the TSJE, Jorge Bogarín.
He clarified that his refusal to refer to the case in detail is strictly due to the fact that, as a minister, you will also have to pronounce on the matter and, if you advance your position, they could make the mistake of preopining.
