The files were referred as an urgent matter to Minister Lenia Batres, who is close to Morena and has promoted the judicial reform of President Andrés Manuel López Obrador, so she must present a project to the Plenary, in which she will propose that the request be processed, however, there is no specific time frame for issuing that response.
“This matter shall be referred to Minister Lenia Batres Guadarrama, in accordance with the order kept by the General Secretariat of Agreements of this High Court,” it states.
These consultations were made by the President of the Court after receiving various letters from District Courts and Circuit Collegiate Courts on September 2, 3 and 4, 2024, in which they requested the High Court to exercise its power provided for in Article 11 of the Organic Law of the Judicial Branch of the Federation, in relation to this judicial reform. In said letters, the persons who promoted it requested that the current constitutional reform procedure in judicial matters be suspended.
These questions are intended to clarify cases where there are doubts about the procedure to follow.
The Organic Law of the Judicial Branch of the Federation, in its article 11, indicates that the Plenary of the Court has the power to hear and resolve any controversy that arises between the Chambers of the Supreme Court and those that arise within the Judicial Branch of the Federation due to the interpretation and application.
This reform to the Judicial Branch – which establishes that judges, ministers, magistrates be elected by direct vote – was approved yesterday Wednesday by the Chamber of Deputies and that same day it was sent to the Senate, because it is expected to be discussed in committees next Sunday.
