New cut changes rules: judicial clock, itinerant sessions and transparency

Now they will have up to seven minutes to expose their arguments and, concluded all interventions, the rapporteur will have up to five minutes to respond to all of them in a single participation.

If there is a second round of discussion, the ministers will have a maximum of five minutes to intervene and the rapporteur will respond to all the arguments that have been poured for three minutes.

“When the matter merits, in an exceptional way, the Presidency may open the rounds of debates that it deems necessary, setting the intervention time.”

What days will they meet?

In the previous period, the SCJN met Monday, Tuesday and Thursday. Before the judicial reform had two rooms, from the eleven ministers five they made up the first, which resolved civil and criminal matters; The second attended administrative and labor cases and the presidency of the Court did not integrate a Chamber.

Now that there are no rooms for the Plenary of the SCJN, it will meet four days, from Monday to Thursday, and if it is remembered, you can meet another business or inhabil day and “exceptionally, you can do it on Fridays.”

On Mondays and Tuesday, the resolution projects will be discussed that enter into the Background Study of Constitutional Controversies, unconstitutionality actions, nonconformity resources, incidents of judgment inejection and general declarations of unconstitutionality.

Other issues that will be for those days will be those related to criteria contradictions, constitutionality of the popular consultations convened by the Congress of the Union; Review resources in national security and issues in which sentences are received from the Inter -American Court of Human Rights (IACHR), dictated against the Mexican State.

All these matters were resolved by the plenary of eleven ministers, it will now be the nineteenth.

The issues that were previously from the First Chamber: Criminal and Civil Matters will be seen in the Plenary of the SCJN on Wednesdays.

The cases related to administrative and labor matters, which in the past approached the second room, will be the subject of the courts of the Court on Thursdays.

Affairs that the second room saw and related to amparos and their background study, requests for attraction or issues that do not merit fundamentals will be indistinctly Wednesday or Thursday.

Exceptionally they can also meet on Fridays.

The itinerant sessions of the SCJN

Session outside the SCJN and in the field, was raised by the today Minister President Hugo Aguilar Ortiz during his campaign to get the position and before there was no possibility.

Before there were ordinary and extraordinary sessions in addition to private ones even if it was not expressly established in its regulations.

Now five types were set: ordinary and extraordinary; solemn sessions; private sessions and extraordinary sessions in territory (itinerant)

“When determined because of the interest and transcendence of the matter in question” Plenary may meet at headquarters other than the main one, located in Mexico City and exceptionally.

Those will be the extraordinary sessions in territory and will be agreed by their own decision or the request of the citizens “exposing the reasons that motivate it.”

It must be requested that this plenary modality be carried out before the instruction closure (that is, before the project that will be taken to the vote); in the case of constitutional controversies and unconstitutionality actions or before the publication of the list in other cases on other matters.
