“Nenecho” asks to limit the number of stations in Asunción after allowing proliferation for more than a year

On November 30, Óscar “Nenecho” Rodríguez, mayor of Asunción, posted on social networks that he had sent a draft ordinance to the Asunción Municipal Board to regulate the authorization of construction of service stations.

In the video published on networks, the mayor mentioned that accompanying the constant citizen claim and considering that the Supreme Court of Justice has not ruled on the unconstitutionality raised to that ordinance that regulates the proliferation of service stations, he has sent a draft ordinance to the Municipal Board that regulates the authorization of construction of service stations.

“It is important to mention that after a long and exhaustive study we have reached the conclusion. Despite the fact that on several occasions we have requested intervention in said unconstitutionality in the Supreme Court and have received no response, we have worked with legal advisors to have the legal framework and prohibit the further installation of service stations in the city of Asunción. We hereby request the municipal councilors to accompany this project for the benefit of Asuncion and non-Asuncion citizens, “he said in the published material.

Rodríguez, who has been highly questioned for his performance before the municipality and after the ordinance project that aims to regulate the authorization of station construction, revived an old controversy regarding the installation of pumps.

It is that 153 stations are located in Asunción, with this city having the largest number, according to data up to August 2022 from the Fuel Market Observatory of the Ministry of Industry and Commerce (MIC).

On more than one occasion, leaders of the sector as well as other authorities have begun to question the massive authorizations that have been given for some time now, due to the contamination that these points represent and the little margin that it leaves for the business.

The last case was the Enex located in Kubitech and Mariscal López, which obtained authorization to settle in the area, despite being in front of a hospital and in close proximity to an Embassy and Mburuvicha Roga. In this sense, the mayor of the capital affirmed that the Ministry of the Environment and Sustainable Development (Mades) is the one that authorizes the authorization of service stations and not the Commune. He spoke that when the Municipality does not find any legal impediment to prevent whatever the business is, it must enable it.

“The one from Kubitech and Mariscal López enabled Mades with an authorized environmental license that met all the legal requirements and I cannot not approve,” he added.

In addition, he argued that he was not the mayor or councilor when that company obtained the authorization, but the person who signed was the previous mayor when he resigned and was in full campaign.

LIES

Given the statements of the mayor regarding regulating the qualifications of these fuel companies “due to the constant demand of the citizens”, sources of the newspaper affirm that “Nenecho” in April 2021, before resigning in June to run for re-election, vetoed draft ordinance 326/2021 that rendered ordinance 7/2011 null and void, which, due to judicial protection, allowed the proliferation of service stations in Asunción.

That is, instead of promulgating the ordinance, the vein. After 18 months, and with approximately 36 new stations in Asunción, the mayor decides to present a project to limit the number of emblems.

THE ORDINANCE

Ordinance 7/2011 that was vetoed established the 1,000 meter distance in a straight line for each station. But due to a judicial protection, it was without effect. The ordinance. 326/2021 established the same, but by eliminating the previous one, the judicial protection was also eliminated.
