Nelva Cruz on the law of conceived unborn children: ‘This project does not seek peace and is not legally appropriate’

More than 20 organizations and activists for the human rights of women, children and the family have asked the plenary session of the National Assembly to reject Bill 18, which creates a registry of unborn children conceived, which was approved in first debate on March 15 by the Commission for Women, Children, Youth and the Family.

According to the doctor of law, specialist in gender and human rights and member of Science in Panama, Nelva Araúz, this project does not seek peace for society or for mothers, and it is not legally appropriate either.

“This is serious, because a project of this nature brings other legal consequences, given that from the very explanatory statement there is an intention to create a sense of person with the legal implications that this entails to whom our legislation has not given that sense. ”, he stated.

He specified that the project establishes at all times that everything is voluntary, however “there are no laws that are voluntary compliance.”

He said that there is a kind of deception towards society, regarding this bill.

“This would imply rethinking human rights norms where in all parts of the world it is established that the person, their rights and obligations begin with birth and not before,” Cruz said.

It should be remembered that, during the approval in the first debate, the proposing deputy, Corina Cano, from Molirena, pointed out that the proposal establishes that the registration of unborn conceived children will be carried out at the request of the mother or whoever she authorizes in the Civil registration.

In the event that the mother cannot express her will, the right to the biological father or cohabiting spouse, or any of the consequent born in a straight line of first degree of consanguinity, is recognized, he said.

The proposal would modify article 60, chapter V of Law 31 of 2006, modified and added by Law 17 of 2007, of the Civil Registry, and would create the registry of unborn children.

This project was presented for the first time in the National Assembly in July 2019.
