Santo Domingo.– The National Council of the Magistracy (CNM) resolved this Friday to review Regulation 1-19, which defines the criteria and the procedure for the evaluation of the performance of the judges of the Supreme Court of Justice (SCJ), with a view to guaranteeing the efficiency and quality in their functions.
The measure was adopted in the first CNM session aimed at dealing with both the evaluation of the SCJ judges and the designation of the members of the Superior Electoral Court (TSE).
The meeting was convened by the President of the Republic, Luis Abinader, who presides over the agency, and took place in the National Palace.
The council members indicated that, before proceeding with new designations or possible ratifications, it is common to review the previously established conditions.
“The National Council of the Magistracy usually makes regulatory adjustments in each call. On this occasion, it was agreed to review only regulation 1-19. If said review implied modifications, these would be submitted to public consultation for 20 days to receive opinions of citizens and interested,” explained the legal consultant of the Executive Power, Antoliano Peralta Romero.
Once that stage is completed, the CNM will know the work schedule to advance with the replacement or ratification of judges.
All members of the Council participated in the meeting: President Abinader; the presidents of the Senate, Ricardo de los Santos; of the Chamber of Deputies, Alfredo Pacheco; of the Supreme Court of Justice, Luis Henry Molina; and of the Constitutional Court, Napoleon Estévez Lavandier. Senator Omar Fernández, deputy Tobias Crespo and magistrate Nancy Salcedo Fernández, who participated virtually.
Objective of the call
As communicated, the call contemplates the evaluation of the performance of magistrates Blas Rafael Fernández Gómez, Pilar Jiménez Ortiz, Manuel Alexis Read Ortiz and Moisés Ferrer Landrón, who have already turned seven years in their positions, in accordance with article 181 of the Constitution.
Likewise, the calling calls was included to occupy the vacancy left by Judge Napoleon Estévez Lavandier in the Supreme Court of Justice, and others that could be opened after the completed evaluation process mentioned above, according to article 180 Constitutional.
Finally, applicants were also summoned for judges and alternates of the Superior Electoral Court, because the current Plenary mandate concludes in July 2025, in accordance with the provisions of article 183 of the Magna Carta.
