The Congress of the Union has been missing for more than four years because it has not issued the National Code of Civil and Family Procedures, which was forced by the constitutional reform approved on September 15, 2017.

Researchers Juan Manuel Rodríguez and Miguel Ángel Barrón, from the Belisario Domínguez Institute of the Senate, highlight that civil and family trials are the issues that represent the greatest burden on state judicial powers, since in 2020 they accounted for 64 percent of all files. and criminal cases filed in the country’s courts.

In the investigation called Aspects to be considered in the issuance of the National Code of Civil and Family Procedures, Rodríguez and Barrón highlight that on September 15, 2017, the constitutional reform in matters of daily justice was published, which, among other things, empowered Congress to the Union to issue a single legislation on civil and family procedural matters in which a term of 180 days after the entry into force of the reform was determined; however, after almost four years this legislation has still not been approved.

The researchers indicate that the new law must include the civil oral trial, mechanisms to guarantee the execution of sentences and digital justice, the latter through figures such as the online trial, electronic notifications and operational management systems.

Three initiatives have been presented in the Congress of the Union to issue a code, which are pending ruling.

On April 28 of this year, the Chamber of Deputies approved the creation of the working group on everyday justice, which aims to identify, review, analyze, modify and propose the harmonization and standardization of the respective laws.

They insisted that it is important that the state judicial powers have procedures that allow for greater efficiency in their performance.

On the other hand, the coordinator of the Morena senators, Ricardo Monreal, called on those who make up the Congress of the Union to overcome the electoral process, reconcile positions and build the legal instruments that are essential for the population, such as the National Code of Procedures Civil and Family Law, which seeks to facilitate access to daily justice, with simple, fast and effective resources.
