Misael Nallar, accused of being the main person responsible for the triple murder of policemen in Santa Cruz, will stay at least until Tuesday in the Chonchocoro maximum security prison.
This information is known after Saturday night the Seventh Criminal Sentencing Court, made up of judges Freddy Coronel, Yanet Paniagua and Claret Llanos, responded to the Freedom Action in the Court of Constitutional Guarantees filed by Nallar’s defense with an order to Rodrigo Vedia, Criminal Investigation Judge First of La Guardia, to “issue a new resolution duly substantiated” within 24 hours of its legal notification.
Vedia had previously ordered preventive detention for 180 days for Nallar in the Chonchocoro prison in La Paz.
“The sentence came out on Saturday. The notification will be made tomorrow (Monday), on the first business day. The judge (Vedia) has a maximum of 24 hours to return Mr. Nallar to the city of Santa Cruz”, informed Carlos Antelo, one of the two main lawyers of the investigated.
The Commander General of the Police, Jhonny Aguilera, confirmed today that he has not yet received any transfer order.
This Sunday morning, the Deputy Minister of Citizen Security, Roberto Ríos reported that the legal team of the Police is analyzing the strategy to annul Nallar’s return to Palmasola and for the detainee to continue in Chonchocoro.
“The judge has granted this guardianship, for which harranged for Mr. Nallar to be transferred to the Palmasola penitentiary”, explained the authority to state media.
In this regard, Antelo said: “This is a constitutional action, it is not an appeal for a precautionary hearing, nor a cessation of preventive detention, nor an oral trial so that they have the right to appeal (…). A constitutional action can return upheld from the court or reversed. They (the Government and the Police) cannot file a single memorial, because they are not a party, part is the precautionary judge (Vedia) who violated my client’s right, no one else”.
