On May 8 Political Expansion published that the concession title of the federal maritime land zone on which the pier is projected, belonged to the individual Daniel Fidelio Peraza Marfil, at the time of submitting the Environmental Impact Statement (MIA), which contravened what was reported to the Ministry of Environment and Natural Resources (Semarnat).
It was the National Institute of Ecology and Climate Change (INECC), in its technical opinion on the MIA project, who warned of this and questioned the possession of part of the company of the concession title.
However, Muelles del Caribe denies having issued false information about the legal possession of the Federal Maritime Terrestrial Zone (ZFMT), since Peraza Marfil is its legal representative, since before the INECC analysis.
Daniel Fidelio Peraza Marfil has been the legal representative of MUELLES DEL CARIBE SA DE CV since May 30, 2018. […] MIA 23QR2020H0047, entered in 2020, was approved in December 2021, [dos años] after the concession title of the Federal Maritime Terrestrial Zone was granted, No. GZF1040/2018, which was on November 30, 2018”, reads a document addressed to this medium.
Even though the title granted to Daniel Fidelio Peraza Marfil indicates that the area is exclusively for ornamental and non-profit use, as stated in file 673/QROO/2018 issued by Semarnat, Muelles del Caribe indicated that it does not violate what is established or prohibited, in accordance with article 20 of the Ports Law, which establishes the following:
‘To build and use piers, berths, dumps and other similar ones in general water communication routes, outside ports, terminals and marinas, a permit from the Secretary of the branch (in this case Semar) will be required., notwithstanding that the interested parties obtain, where appropriate, the concession of the Federal Maritime-Terrestrial Zone granted by the Ministry of Social Development, without the use of the concession as decoration, general use, etc. being a requirement”.
