MTC will denounce Martín Vizcarra for debt of $ 100 million generated by the Kuntur Wasi case to the State

The Attorney General’s Office Ministry of Transport and Communications (MTC) will file a criminal complaint against the former president Martín Vizcarra for the debt of 100 million dollars that the State must assume after the international arbitration of the Kuntur Wasi case. According to the head of the sector, César Sandoval, the damage originated by the unilateral resolution of the Chinchero airport contract in 2017, when Vizcarra was a minister of this entity and Fiorella Molinelli occupied the vice minister.

Sandoval explained that the measure will also reach about twenty management officials of Vizcarra, who would have had direct participation in the subscription and subsequent rupture of the agreement with the Kuntur Wasi consortium. The arbitration was resolved by the International Center for Arrangement of Differences Relating to Investments (CIADI), which determined the responsibility of the Peruvian State and ordered the payment of the millionaire compensation.

“I have made the decision to tell Peru that he is responsible for that debt and begins with former president Martín Vizcarra, for his exviceminist, and there are about twenty officials who will have to answer for that debt that is unfair and that has been worked and that surely the judges and prosecutors at the time, in the procedure that has to be developed, will find the responsibilities,” he said.

The MTC representative said that the complaint does not only seek criminal sanctions, but also the recognition of damages against the former officials involved. Therefore, the case will be sent to the Anti -Corruption Attorney’s Office to boost the corresponding actions.

The minister added that, so far, the State has not disbursed any money to Kuntur Wasi, despite the adverse ruling. He said that he first chose to investigate and denounce those responsible before executing any payment. “When I entered in May there were voices that asked to pay, but I said, I will first investigate, I will report and I will publicize the Peruvian people who have generated these 100 million that leaves the pockets of each of the Peruvians,” he said.

The Kuntur Wasi case and Chinchero airport

The Kuntur Wasi consortium, composed of the Argentine company Corporation and the Andean Peruvian Investment Holding, obtained in 2014 the concession to build and operate the Chinchero International Airport in Cusco. However, the contract was annulled in 2017 by decision of the Executive, which argued breaches in the financing and lack of guarantees in the execution of the project.

After cancellation, Kuntur Wasi resorted to international arbitration and Ciadi determined that the termination was arbitrary, forcing Peru to pay around 100 million dollars as compensation. Failure to comply with this payment led to the San Diego Arbitral Tribunal to declare the country in rebellion, which generated concern about possible additional sanctions.

Today, more than seven years after the resolution of the contract, Chinchero airport records less than 40% progress, according to official figures from MTC himself.
